The Unified Patent Court (UPC) will have jurisdiction to rule on the validity and the infringement of any patent application and European patent (except in case of Opt-out), including the European patents with unitary effect, as well as of the related supplementary protection certificates (SPC).
It will enter into force after the ratification of the Agreement on a unified patent court by at least 13 of the states having signed the Agreement, including France, Germany and the United Kingdom.
The countdown is launched and, according to the latest available forecasts, the patent with unitary effect and the Unified Patent Court should be inaugurated by end of 2017/beginning of 2018.
